In addition to improving family violence processes and procedures for genuine victims, creating strong consequences for false claims and making parental child abduction illegal, what should be done?

The most important yardstick is whether parents and children are meeting each other or not. Under the current system, the percentage of children meeting both of their parents post divorce is woefully low in Japan. On top of that, the small amount of time that children spend with their ‘non-residential parent’ is beyond embarrassing and is a disgrace.

真正な被害者のための家庭内暴力のプロセスと手続きの改善、虚偽の申し立てに対する強力な結果の創出、親による子の奪取の違法化に加えて、何をなすべきか。

最も重要な基準は、親と子が会っているかどうかである。現在の制度では、離婚後に子どもが両親と会っている割合は、日本では極めて低い。その上、子どもたちが「非居住者である親」と過ごすわずかな時間は、恥ずかしいことこの上なく、恥ずべきことである。

In order to truly be a ‘children first’ family law system Japan could take a leaf out of Australia's book and aim for children to spend substantial and significant time with both parents regardless of the parents’ marital status. This includes parents who have never been married.

Children have the right to know and be freely loved by all of their relatives including grandparents, aunts, uncles and cousins. Significant people in children’s lives should be able to apply to the courts for access.

日本が真に「子ども第一」の家族法制度となるためには、オーストラリアを見習い、両親の婚姻関係にかかわらず、子どもたちが両親と実質的かつ重要な時間を過ごすことを目指すべきである。これには、結婚歴のない両親も含まれる。

子どもには、祖父母、叔父叔母、いとこを含むすべての親族を知り、自由に愛される権利がある。子どもにとって重要な人物は、裁判所に対して面会交流を申請することができるべきである。

Access, once mutually decided upon whether in an agreement, mediation or by a judge, needs to be legally binding and enforced by the courts. Parents who fail to meet their obligations need to be sanctioned and lose rights for repeated violations. 

合意であれ調停であれ裁判官によるものであれ、いったん相互に決定されたアクセスは法的拘束力を持ち、裁判所によって強制される必要がある。義務を果たさない親には制裁が必要であり、度重なる違反に対しては権利を失うことになる。
